Terms and Conditions

 

Lakeside Play – Terms of Quotation

1. Validity of Quotation

This quotation remains open for acceptance for 30 days from the date of issue. If you are unable to confirm your order within this period, Lakeside Play will endeavour to minimise any necessary price adjustments.
Lakeside Play reserves the right to decline any order if the quoted products are no longer available.


2. Prices

All prices are quoted exclusive of VAT.


3. Entire Agreement

These Terms of Quotation, together with any particulars or express terms detailed on the order acknowledgement, form the entire agreement between Lakeside Play and the Client.


4. Formation of Contract

A binding contract is established only when the Client confirms their order in writing, and Lakeside Play issues a written acknowledgement of acceptance.


5. Delivery and Installation Dates

Any delivery or installation dates provided by Lakeside Play are given in good faith but may be subject to change due to circumstances beyond our control.


6. Site Access

The Client must provide suitable and unhindered access to the installation site.
Lakeside Play reserves the right to invoice for stage payments and any additional expenses if delays occur due to restricted access or the actions of others outside our control.


7. Project Progress

Lakeside Play will take all reasonable steps to ensure works commence and are completed within the agreed timescale. Progress may be affected by ground conditions, weather, or other external factors beyond our control.


8. Site Conditions and Underground Services

The Client is responsible for identifying and notifying Lakeside Play of any underground services or other restrictions before work begins.
No allowances have been made for diverting public utilities, pipes, or cables, nor for excavation into rock or unexpected obstructions.
If such conditions arise, Lakeside Play will notify the Client immediately, and any additional costs will be agreed before proceeding.


9. Cancellation

If the Client cancels or withdraws from the contract after acceptance, they will be responsible for all reasonable costs incurred by Lakeside Play up to that point.
Where materials or products have been purchased specifically for the project, full payment for those items will be required.


10. Payment Terms

A 50% deposit is required upon acceptance of the quotation, unless otherwise agreed.
For projects exceeding two weeks in duration, Lakeside Play reserves the right to issue stage payment invoices.
The final invoice will be issued upon completion of the works.
No retention shall be withheld by the Client unless agreed in writing.


11. Credit Terms

Payment is due within 21 days of receipt of the final invoice, unless otherwise agreed in writing.


12. Late Payment

Interest will accrue on overdue sums at a rate of 3% above Barclays Bank Plc’s base rate, calculated daily until full payment is received (both before and after judgement).


13. Ownership of Goods

All goods remain the property of Lakeside Play until full payment has been received.
Lakeside Play reserves the right to remove any unpaid goods from site if necessary.


14. Planning Consent

It is the Client’s responsibility to ensure that all necessary planning permissions are obtained prior to installation.


15. Manufacturer Warranties

Manufacturer warranties apply only where the Client can demonstrate that regular maintenance has been carried out by an approved contractor in accordance with the manufacturer’s recommendations.


16. Lakeside Play Installation Warranty

Lakeside Play warrants the installation of all equipment and new safety surfacing specified in this quotation for 12 months from the date of completion.
This warranty excludes:

  • Normal wear and tear
  • Vandalism or puncture damage
  • Damage from strimming or improper cleaning
  • Graffiti removal
  • Acts of God (e.g. flooding or ground movement)
  • Misuse or use outside the intended purpose of the equipment
     


17. Safety and Maintenance

It is the Client’s responsibility to ensure ongoing safety and maintenance of all equipment.

  • Annual inspections should be carried out by an independent qualified inspector.
  • Quarterly maintenance inspections and weekly visual checks are recommended.
  • Any damage, algae, moss, or dirt must be rectified immediately.
  • All timber and steel components must be cleaned, treated, and maintained annually.
  • All moving parts must be checked regularly and replaced as required using approved spares.
     


18. Product Design

Lakeside Play reserves the right to modify or improve product designs featured in any marketing material in the interests of product development and safety.

Return and Refund Policy

 

Lakeside Play – Returns & Refunds Policy

1. General Policy

At Lakeside Play, all of our products and installations are made or supplied to order and customised to suit each individual project.
Because of this, we do not operate a standard returns or refunds policy. Once an order has been confirmed and production or installation has begun, it cannot be cancelled, returned, or refunded.


2. Made-to-Order Products

All playground equipment, surfacing, and associated materials are manufactured, finished, and/or ordered specifically for each project.
As such, we are unable to accept returns or issue refunds unless the goods supplied are proven to be faulty, damaged, or not as described in your contract or quotation.


3. Faulty or Damaged Goods

If you believe that an item is defective or has been damaged prior to installation, please notify us in writing within 7 days of delivery.
Lakeside Play will inspect the goods and, where appropriate, arrange for:

  • Repair,
  • Replacement, or
  • Refund (at our discretion).
     

This does not affect your statutory rights under UK consumer law.


4. Cancellations

Once a quotation has been accepted and an order confirmed, cancellation is only possible at Lakeside Play’s discretion.
If materials have already been ordered or work has commenced, the Client will be responsible for all reasonable costs incurred up to the date of cancellation.


5. Completed Installations

Due to the bespoke nature of our design and installation services, completed projects cannot be returned or refunded once installed, except where there is a verified fault covered under our installation warranty or manufacturer’s warranty.


6. Our Commitment

We take great pride in our workmanship and product quality. If you experience any issues with your order, we will always work with you to find a fair and practical resolution within the scope of our warranty and contractual terms.
